I was put on medical leave due to stress for 2 weeks. I informed my employer that I would be filing a claim thou the state. Three days after I informed my employer that I will be filing a claim with the state they in turned filed a workers comp claim. I have three questions: 1) Can my employer file a workers comp claim when I have already filed for state disability. 2) Since my employer filed a workers comp claim will this delay my return to work as well as my benifits. 3) Can my employer terminate my employment with them when I return from my medical leave.
