Default Wells Fargo Wrongfully repod car NEED HELP ASAP!!!

I need help. Not sure where to start so I am just going to start from the very beginning of how it all started.


Friday night, I am driving my car. Out with my fiancée to dinner. We come home around 8:30pm and there is a truck parking the parking lot behind my Fiancé’s car and blocking 2 other cars (I live in an independentally owned apartment building).

I park and just say to myself (asshole needs to learn how to park).

Anyways, We go inside. About 10 minutes later we hear a knock on the door. The guy asks for Melody (my fiancé) and says he is here by order of Wells Fargo to repo her Pontiac.

She starts freaking out as to why; she makes all her payments on time. Just got the car 5 months ago, just sent out the most recent payment.

Anyway. the deal is. Her contract for the car shows that her payments are $275 a month. Wells Fargo is saying that she owes $398 a month though. Different then the amount on the contract.

The car is insured through an outside insurance company. But Wells Fargo has taken it upon themselves to add there own insurance on the car. Which the contract says they will do if insurance isn't put on the car by the person taking out the loan. We all all proof the car is insured and they had no reason to add this extra amount. They never informed her ONE TIME by phone or mail of it. They also never sent a single letter or called once regarding it being repo'd or what not.

They say she owes 1600 to get it back, She has 10 days and the car gets shipped out to California and she can't get it back at all.

We was told that we need to speak to a lady named Michelle at Wells Fargo Auto on Saturday and that she would be in to speak with us, ALl day Saturday we call, leave messages nothing. No answer no return call.
All day today (monday). same thing.. calling calling no answer no return of our calls.

We try to speak to other people in the Repo department at Wells Fargo They just tell us that only Michelle can speak to us regarding the matter. We are on a time limit and are being charges $200 a day additional for storage of teh vehicle which makes it worse.. We only have $1100 cash

Our main concern is getting the car back before it's shipped out to California like the Repo guy said it would be. Then we want to get in to teh matter of why the hell they are saying her payments are more then the contract shows them at, and why they are charging her this insurance for no reason when they have proof the car is already insured and the agents backs up that no cancellation of insurance letter has ever been sent to Wells Fargo.

CAn anyone help us out PLEASE? We are at a loss on what to do, we can't get a hold of anyone taht will speak to us to give us answers and we only have 10 days (minus 3 now)


That is the story in a nutshell.. and last week we got denied for a house we was trying to buy. But, our meeting with the lender to go over why we got denied got cancelled Thursday. So we wasn't able to find out why a head of time or we would have found this screw up a few days sooner but it's also messed up her credit and costed us our house we was closing on July 9th.

Depending on your contract with the bank, you have to show proof of insurance to them. I would suggest that you speak with an attorney who can go over the contract and help you get this worked out. We had one attorney who said we have a great case against them. Bad part is he said he works in this line but for Wells Fargo. He is a friend of my moms though so he said he can guide us on what to do but will not be able to represent us in court on anything official. But he is going to find us someone that can represent us on paper.

One of our biggest things we are curious about is, What are the chances of even getting the car back to begin with?. When a car is already repo'd is it usually statistically that most peopel don't get the cars back?. They give us 10 days which isn't even enough time to get the paperwork around but we are trying. But if there really is no chance of even getting the car back then we are going to stop rushing and take our time a bit to make sure we got all paperwork to take them to court.

I found some stuff on another site that has a huge list of people that are going through the exact same thing as my Fiance also and are considering starting a class action lawsuit so I hope maybe that is something we can get on to as well.

They will not even speak to my fiance untill she faxes them 4 references, 2 pay stubs, and proof of insurance. I don't understand why they need that just to speak to her about it. But her paystubs and insurance papers are all in the car. They are not allowing her to collect any personal property at all.

The proof of insurance will be no problem but it will probably take weeks just to get her job to re mail out copies of her most recent pay stubs. And this is just to get Wells Fargo to even SPEAK about the matter NOT to get it back.

Even the attorney that works for Wells Fargo that my mom knowns said that makes no sense at all.
