In 1999 I was charged with cultivation/possession of marijuanna. My attorney achieved sentencing of judification withheld along w/ 3 yrs probation. In 2001 I violated w/ additional marijuanna possession. Was sentenced to 6mth rehab facility comm. serv. hrs. 2 yrs. comm control and 3 yrs probation. Completed rehab perfectly and after 14 mnths of CC it was rolled over into my probation. I am currently into my last 20 months of probation (without any incidents and also have completed paying fines) and during my last monthly reporting the drug test showed failure due to methamphetamine. An affidavit has been filed (soon to be warrant). I notified my PO that I have not done any illegal drugs whatsoever and gave him the only over-the-counter product (containing pseudoephedrine) that I have taken. Can anyone give me an idea of what I'm facing? Is there any defense against this incorrect test result?
