Violation of victim and defendants rights????
My boyfriend got arrested on 10-31-07 and was in court until 2009. Originally, the charges were DV but were reduced to disorderly conduct and DUI, 3 years probation, 3 months in jail with work release with 3 months suspended. They never requested my presence and I was only notified of court dates until 2008. Recently he was doing a friend a favor and moved a bike not knowing his lic was suspended. I was at DMV with him when they told him it would be cleared up 2-1-10. He was pulled over and cited. tomorrow is his pretrial for the lic issue and violation of probation. Sunday he had a voice mail saying there was a warrant for his arrest.
I was the supposed to be victim originally. I was under a severe regiment of pain medications that were stronger than what is given to terminal cancer patients. I was on 300mg of fentanyl every 48 hrs which I is 100 times the strength of morphine, that does not include the other narcotics that i was on daily. I took upwards of 70 pills a day and literally did face plants in my food. I was not only allowed to sign affidavits but i was intentionally kept from the defenses attorney and told specifically that it was due to my medications. I was told by the prosecutor what to say during written statements and told when to stay away from the court room, I believe due to my intoxication level. The judge never saw me once. I tried to get ahold of the prosecutor several times and left several messages that were never returned. I made it clear that i was not comfortable with the situation but i have no proof of this, however, I do have proof of the amount of medications that i was on and that my doctor took me off of them a year and a half later due to his concern with my well being.
I feel strongly that I was taken advantage of and used as a dummy on the cop and the prosecutors lap. Until this call happened I had no idea what my rights were and disagreed with his sentencing when I FINALLY found out. If they can do this to the defendant, they can do this to anyone. I want to right a wrong. Can I do this and if so how? I strongly feel that there was gross negligence on their part against me and the defendant. I stopped 95% of my medications in early 2009.
From what I've read while on probation they can take him to jail at anytime. His life is doing so well and we are expecting a baby!
What are his rights? What are my rights? Can I do or say anything at court to stop or even reverse this all?
