Unhappy Violation Of Probation rights?

my boyfriends probation officer violated him for no reason. She treats him like a child and didn't want to discuss it over the phone since we all know the converstaions are recorded and she knew she was talking wrong. What can be done about this and how can we beat this. I am so sick of probation officers doing whatever they want to be rude and lock people up. They should not be allowed to get away with this. We have 2 small children and this beep wants to break are family up and he is changing his life and you wonder how they always turn back to crime. The system is very messed up and something needs to be done about this. I am a student majoring in criminal Justice and I hope one day I can turn this system around and make it how it should be. I would defiantly like some advice on what legally can be done about his probation officer, like filing a complaint against her or hiring a lawyer. Thank you

I know you feel he's being violated for "no reason"...but what does the reason on her paperwork say? That's where to attack it first. You have to be able to quantify and describe what it is that she' doing, whether it's filing a false report, reporting violations that aren't included in his probation, or some other thing. Once you know exactly what's being sent "upstream" in the system from her, THEN you can file a complaint at the state level with the Board.

I do agree with the aardvarc. I also think that your boyfriend my want to speak with an attorney if he has been violated since there is the chance of going to jail. You can locate an attorney through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/. Some do offer free consultations.

Just as a side note, if you're majoring in criminal justice, you might want to re-think before you have too much invested. In just about ANY position where you'd need a criminal justice degree, you'll have a hard time passing most agencies background check for employment if you're living with a probationer (since they typically investigate everyone in your household, along with neighbors, co-workers, teachers, etc.)
