Default Verbal Agreement Binding?

I work for a home builder here in New Mexico, this builder told my wife and I that we would be getting one of the first homes built in a new sub-division. This builder changes their story constantly, and things seemed to have changed between now and two years ago when we were first told about getting a home. Is this builder bound by his verbal agreement to give us the house? We would get a 1099 for the home. Any advise would be greatly appreciated.

Every state has different laws regarding matters such as these. I would suggest that you speak with an attorney that has experience in this area to discuss your legal options. Default Better if it is in Writing

It would be to your benefit to have some written evidence of your agreement. For example, from your posting it is not clear whether you will be entitled to a free home or whether you would be entitled to purchase it. If so, what was the price that was quoted and when (what date) would it be available to you (?) Those would all be key facts in any agreement. Have you thought of writing your employer a letter?
