My husband and I are trying to get custody of his 9 year old child. His child has stated on numerous occasions that s/he wants to live with us and not her/his mother. We currently live in La. and they live in Ga. (which has jurisdiction). We have an attorney but we have been feeling lately she caters to his ex. It seems that everytime we do something we end up on the losing side and his ex receives all the benefits of the attorney we are paying for. His ex has been found in contempt of court on more than one court order and this is never brought up. His ex calls our attorney just about daily and it seems that they "hint around" as to what she should or should not do.

Please advise us on what we should do. We are thinking of hiring a new lawyer but then again we don't want our current attorney to go represent his ex. Not that we do anything wrong but we feel it would be a conflict of interest. Also, how old does a child have to be before they can choose which parent to live with? I've tried researching this but everything I read seems to give me a different age.

I responded to your other post and your attorney cannot go an represent her if you hire a new attorney. It would be a clear conflict of interest.
