Default Unsecured Debt Court Cases Won

A law office is representing an unsecured credit card company for a debt that was discharged several years ago. The account was sold to a collection agency and then sold off to the law office who is now taking legal action via a court case to collect on this debt. The settlement they would be willing to take from me is 70% of the original debt plus their lawyer fees. I am a working single parent. I told the law office that I could make a $30.00 payment but this was declined with them saying the minimum had to be $100.00. How many unsecured credit card debt cases have actually been won by "debt" collectors in AZ? Is there a website that I can access these type of cases?

How much is the debt? Usually they can take you to "civil" court but can't actually "force" payment. They could garnish wages and put a lien on a home, but usually the who lawsuit is just a trick to force payment.

The debt is over $3k from 2002/03. It shows charged off on my credit report with the debt being sold to a collection agency in 2007. I found through Superior Court AZ online that the motion to "sue" me was filed in May 2008 with the default motion mailed to me just this month. It was mailed to my PO Box and I have never been served nor received any other notifications other than this default I found in my PO Box.

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
