Default unpaid benefits

My ex husband is on Social Security Disability and also receiveds a monthly check for our daughter. During the divorce he was ordered to equally divide her monthly check between him and I for her expenses during the time we each have her. He is over 3000.00 behind and refuses to give me the court ordered 1/2 of her check. At the present time we have joint physical and legal custody (have custody modification hearing next month to try and get this changed). What can I do to get him to pay this? My contempt charges keep getting thrown out by his attorney.

On what grounds are the contempt charges thrown out? What does the attorney say to legitimize his being in contempt of a court order?

Hire an attorney and head back to court.

I agree. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
