Default Unfair Termination

On a scale of 1 to 5, 5 being the best, I was rated a 4 every year. New center manager began 01/01/2008,He insisted that I rate all of my direct reports a 2. I disagreed. He prepared, rated and delivered my 2007 performance review by 01/24/08 rating me a 2 based on one objective. I did not receive the annual merit increase or yearly bonus. He insisted that I change my direct reports performance rating to a 2 and make sure that Compensation Express reflected a 2 rating and do not assign merit increases, I made changes to the staff still employed and adjust ratings on those no longer with company. From that point all dealings with my new boss grew more uncomfortable for me and felt like a hostile environment. He began making down grading remarks, insinuations and picking at everything I did or said. I could do nothing right.

05/03/08 I was placed on a 30 day notice to improve performance and fired 06/06/08. The Performance Plan stated we will rate your progress by comparing your team’s and collector’s future performance against their current performance. These results need to show immediate improvement and continues, consistent improvement month over month. April's performance I missed by $4,700,000 May I missed by only $67,000 which is a substantial improvement. I believe this is retaliation and wrongfully termination, do I have any recourse?

I can certainly understand this is a frustrating situation for you. Some states are at will employment so you can fire someone for anything as long as it is not illegal. I suggest you contact an attorney to determine your legal options. You can find an attorney through the locator service on LawInfo’s home page at: http://www.lawinfo.com/.

You can also browse through the information in LawInfo’s Free Legal Resource Center here: http://www.lawinfo.com/index.cfm/fus...lient.consumer, or search for your particular topic here: http://resources.lawinfo.com/index.html.
