Default unethical broker creates possible disaster

I have a serious problem. I was divorced in 2001, and given the house in the settlement, ex was supposed to sign quitdeed but never did. Then, Feb. 2004 I agreed to allow ex to do a refinance because supposedly the payment would decrease from a lower interest rate, but he rolled in a previous loan he was ordered in divorce to pay himself. He promised to pay the fair difference which would help us both. At the refinance, the broker only had me sign some of the paperwork as co-signer, but not others. I specifically asked if it would create any problems with me being able to have equal access to the account since the payments would come out of my checking acc. He assured me it would be no problem. The broker had us sign papers stating that we were both still owners of the property. Since the quit deed was never done we assumed this was true. My ex also gave them a copy of our divorce papers that showed the ruling that I was given the house and he should have signed a quitdeed, but nothing was said. When we signed the paperwork we did not have a lawyer present, but trusted that the broker was ethical. The broker didn't have a lawyer present either( the broker went out of the room saying he was going to bring their lawyer in, but came back alone and said the lawyer was " tied up" with another client). After we had signed everything, then their lawyer came in and just signed the documents without checking them. Shortly after this our loan was transferred to a different mortgage company. Then the problems began. They completely refuse to talk to me about the loan at all. They told me that they have absolutely NO paperwork with my signature on it. My ex has faxed them repeatedly requesting that I have full access, but the faxes never seem to make it into the file. Here is the worst part- My ex-husband Now has LEUKEMIA and could die at any time. He is also remarried. He and I have two children together and now I am afraid I will lose the house. I do NOT know what to do.

I can understand that this is a frustrating situation. I would suggest that you and your ex speak with an attorney about getting you a power of attorney over this account, but also to go over all the paperwork.
