Unauthorized use of blood test

I am looking for information on whether a blood test is admissible. Man is arrested for DUI. While being put into the police car he injured his back and was taken to the hospital. While at the hospital the doctor ran a blood test. He never signed a release or authorized anyone to view his patient records. When he shows up for his preliminary hearing the prosecutor has a copy of the blood test from his hospital records. Is this legal? If someone is in custody can their medical records be turned over without their consent? What about HIPPA?
