I am designing the menu and a website for a restaurant in Baton Rouge, LA. I had a photographer take shots of each dish, and many of the photos contained either a bottle of Tobasco or a bag of Lays potato chips. Is it illegal in any way for me to use these photos in the design of the menu or website? Will I need to obtain permissions from those companies to include their products in our photos? I would rather not have to retake the photos if possible. Thankyou for your time.

It actually depends on the trademark of each item. I would suggest that you contact the companies directly.
