Default toy company push back

My daughter was chosen by a grass roots toy company to be in a commercial two years ago and has continued involvement since. After a few months I began to lend my marketing consulting services free of charge to help them. I had many red flags about the company and the man that ran it but stuck in because my daughter enjoyed it. Much of the marketing concept, company structure and product deveolpment was done by myself and I have most of that documented. Recently after what I believed to be inappropriate business practices on part of one of their vendors I decided to leave the organization - and attmepted to do so on good terms. Since we have been harrassed, threatend and slandered by this man and even to the point of physical violence against my husband which the police were contacted regarding. We want no further dealings with him but he continues to thrust himself into our lives. The big issue now is that my business is marketing and I have worked on similar campaings previoulsy and would probably continue to but now he is threatening to so me if I ever am linked to anything similar to his product. His product isn't anything new by any standards and he definately does not have a new take on it that would be propietary. I was told I could probably sue him for part of the company if I really wanted to and also shut him down for the inappropriate documentation I have of his dealings with the parents and children involved. But I have no need or want to be involved in anyway. What I do want is copies of any documents he says I have signed regarding non-disclosure or non-compete as I know for a fact I have not yet he persists he has them. We have requested copies with a timeline and advised that we would consider anything not received as null and void. Yet he is not threatening to sue me and is sending slanderous emails to all business associates that we had. I can't loose my livelyhood because of this but I also need to know that he can't come back and bite me later. Any advise would be greatly appreciated!

I can understand that this is frustrating. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. That doesn't necessarily mean you will need to sue him, but a well written letter by an attorney may do the trick. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.

Red face Copy of contracts

I have researched online for several days with no luck on the situation. Here is the real problem without all the drama behind it.

A. My daughter has been offered a contract but part of the agreement will be that she provides copies of all previous contracts so that they are certain they aren't hiring someone that is legally obligated somewhere else.

B. I wrote many marketing plans, virtul world plans, direct response television plans that I shared with him and he later told me he owned but he did not purchase them from me and he has claimed publicly and via e-mails to a mass list that I never gave him anything he is using for his company.


I need to know first if I can legally request a copy of her contracts (which by the way I know of only one contract we signed and it was a model release form) that he claims he has. I do know that someone previously took him to court and he tried to pass off a forged non-compete and was caught. I can't afford to hire an attorney to do this for me is there an easier way. He referred us to his attorney but the attorney stated he is not on retainer with the guy and has not done any work for him in two years. So that was a dead end.

And secondly, what are my rights to my intellectual property which he claimed were his and now is telling people I didn't give him.

I certainly suggest that you speak with an attorney regarding all this. He or she will best be able to help you.

Default Further Harassment

So, after this post in August and a recommendation by our attorney we moved on with business as usual - ignored this man and continued with our lives.

Today out of the blue I get an email from someone representing him (a man named Mike claiming to be an attorney, did not include last name nor his law office name *fishy*) requesting I remove my comments on this site.

I refused as I don't believe I have done anything wrong - an I feel that this is just another form of harassment on his part. I forwarded his message on to everyone else that was involved in the project so that we could see if he was doing this to others and immediately came here to post this message.
