Default Title Insurance Problems

If a title company makes a mistake and realizes it after the transaction is completed who is responsible. I recently had a refi in which Title sent a refund check of several thousand after close of escrow. Of course I cashed the check and bought a few items based on their determination that we had over paid. However a couple of weeks later they sent a letter saying they had made a mistake and the should have not sent us the refund check. Don't they have errors and omissions insurance to cover these type of mishaps. Now they are leaning on me to repay which is virtually impossible. So what leverage does title companies have. Can they place a lien on your property or turn you over to a collection agency. When I talk with them it seems like they are just trying to recover whatever they can but it is essentially something they have to write off. Am I being used to resolve an internal training issue. If I did not make the mistake why do I need to come up with the money. any ideas.

Alliance CAS – Association Collection Company or Extortionist. I recently bought a condo through the Palm Beach County foreclosure auction. I had hired a title search company to do the title search, visited the property, and followed what I considered to be reasonable due diligence.

After I received the certificate of purchase from the Palm Beach County Court, I contacted Alliance CAS via an estoppel request for the payout amount. To my surprise, Scott Jaffee insisted that his company receive over $5000 for legal and collection fees before the lean is released. I contacted my lawyer and he advised me that this sort of practice is borderline extortion and is more that $5000 and hence they continue to get away with such unfair collection practices.
