Question Threat to shoot me with his gun.....

I was threatened by a man who just happens to be a local Bail Bondsman. He said "If you go in your purse I'll shoot you with my gun". He did have a gun at the time of the threat. I was not going into my purse but was picking up my purse from a chair so I could leave per his request. My question is can a Bondsman make this type of threat to me? 911 was on the speaker phone and heard him threaten me, the operator of 911 said to him "sir! You are being recorded. I have never been arrested or even ticketed so this is all new to me. Do I need a Lawyer? What is the punishment in NC for making threats with a gun? Any help would be appreciated.

Threatening with a firearm can often be charged as a type of aggrevated assault. However, not every such threat is unlawful. What are the circumstances that ended up with 911 on the speakerphone?

What happened was he threw me out of his office then took my keys off of the desk and would not give them back to me because he claimed that the paper I had was his and it was not! The paper was my credit card receipt that I brought with me to the appointment to prove I paid. The police later gave me back the paper.

Unless you were charged with anything, there's no reason you'd need a criminal defense attorney.

The punishment for agg battery is up to a year in jail in NC, but if police didn't bring charges against him at the time of the incident, it's unlikely they will.

He recieved a summons to appear in court for threatening.

If he didn't actually wave or otherwise point the gun, then he's probably charged with a simple assault under § 14‑33 - which is a misdemeanor (meaning the punishment could be up to a year in jail). If he's found guilty, he would potentially also face being fired from his job, loosing any state certification related to being a bondsman, etc.

So the most basically is 1 year in jail if jail at all, correct. If not jail then would he atleast be fined?
