Default terminating and signing over prental rights...I need more info please

i have one daughter, soon to be two years old. I am soon to be married to a man who is not her biological father, however he has been her father figure. He biological father has been arrested and jailed 3 times in the past three years. My fincee has medical insurance for me and my daughter, and we jus found out today that unlike we were told, he will be charged nearly 700 dollars every two weeks for mine and her insurance alone, and we cant cancel the insurance unless he leaves his job, which is right now our major source on income. we cant afford to keep paying for the insurance but i need it since i am now 5 months pregnant with out second child and my daughter has some medical needs that has to be kept up to date... we found out once we our married, my insurance will decrease, but insurance for my daughter will still be outragous since right now it isnt legally his child. We had talked about having rights signed over to him and now we know not only do we want to but we need to... I have been hearing mixed things from people at court offices that i have spoken too. My daughters biologically father hasnt paid child support, hasnt seen her in a year, and i dont think he would fight to keep his rights, im pretty sure he would be willing to do it... First off will i need a private lawyer even if both parties agree,and if i do need a lawyer is there anyway to get legal aide for this, second where do i go to start this process and third what do we have to do in order to allow my fincee to pick up rights and replace the name on birth certificate??? can anyone help me out with this?? any info would ne helpful!!!
