My husband and I are renting and living in a home that is currently (we just found out) going into foreclosure and/or short sale. We are month-to-month tenants, BUT, the owner is my biological father.

My husband is NOT a US citizen, and where we haven't the Visa, some laws cause or marriage to 'not apply' in a way from what we've been told.

Because he is renting, and not a US citizen and our marriage is 'up in the air' until the paperwork is completed, does he still qualify for the 90 days notice to vacate (ie., think a vacationer in a rental, going into foreclosure.. would that vacationer have the same rights)? We just need to know how much time we have.
