Default SUV Rollover Accident / Other Party 100% At Fault

My son and I were involved in an accident this past July. The other party failed to stop at a stop sign and hit the rear tire of my SUV (Ford Expedition) which caused us to rollover. My 13 year old son has met the medical criteria for a "personal injury" in the state of Minnesota. He sustained a major cut to his right arm and spent 5 hours in ER having glass removed. A very ugly scar remains and the Plastic Surgeons will take care of it.

My questions are these... My medical has gone over $4k but they minus out ambulance and xrays which has knocked me out of the "personal Injury" category. Due to a major blow to the head in this very traumatic accident, I suffered vertigo for about 2 months after the accident. Is there any compensation for pain and suffering even if a person does not reach the medical 4K criteria.

Can I file a civil suit if the insurance company does not offer me some compensation due to the other party's negligence?

Some Facts:
The other party's insurance company has accepted this claim at 100% fault.
(I've been told this to be rare)
The other part was negligence for failing to stop at the stop sign.

Any advice or input would be appreciated.

I'm sorry to hear about your accident. I do not know what you mean by injuries qualifying as "personal injury." Any injuries you sustain would be considered "personal injuries".... perhaps you mean something related to an insurance claim???

I highly suggest you speak to an attorney regarding your legal options for making a civil claim and otherwise dealing with the insurance company. I suggest you speak to an attorney immediately as there are usually strict timelines in palce regarding preserving your legal options.
