Default Suing for DVDs

I borrowed a guys DVDs. I lived in Indiana as does he. I moved to another state and now he is threatening to sue for DVDs. These DVDs are bootleg from Iraq and redbox movies he did not return. He is saying that he is suing me for the DVDs as well as his lawyer tacking on any other charges he can find going through my school and life history. That is what he is saying at least. Idk if this is possible or if he is just blowing smoke. Please help!!

He absolutely CAN sue you. You're in possession of items that you got from him, and haven't returned them. If he wants to stand in court and testify that he's in possession of illegal materials, that's up to him, and he may have consequences for doing so - but even so, they're not YOURS and now that YOU are in possession of them, YOU can be in hot water too. The court isn't likely to award him damages for the bootlegs, but the burden is on YOU to PROVE they are illegal. As for the Red Box DVDs, he should have no problem getting a judgement against you. Those DVDs were rented on his account, and he's the one facing the fallout for failure to return them. Put ALL of his DVDs in a box and return them to him via registered mail. Having his signature on the receipt showing that he got them is your best defense in court should he decide to sue.

I tend to agree. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
