State Law Enforcemnt Officer filing false police report.
I was recently charged on a felony count as was placed Hennepin County Adult Detention Center on 30 April, 2010 through 4 May, 2010 when I posted $100.000 bail ( for a crime carrying 0-3 years or $3000.00 fine) - a release with "conditions". On May 18, 2010 after returning from a visit with my father in a nursing home in Alexandria ( got permission to travel from PO), I was once more arrested by Columbia Heights police at my residence, was incarcerated through the 20th – learning upon my hearing I was arrested for breaking my conditions – visiting a state office building – the Minnesota Department of Agriculture (my employer of 18 years at that time) on 6 May, 2010.
But I had not visited the building on that date as I had documentation I was in the field doing photography work with my frequent companion & a Ramsey County volunteer.
The complaint (filed by an unidentified state trooper) stated: “Mr. Dziuk was observed by said highway cop to enter the building, leave something at the front desk, went to the bathroom, bought a cup of coffee & exited the building – six minutes elapsed.”
I had gone into the building and dropped off my cell phone & cars keys as the agency was moving to discharge me – they have done so since (just last week), but is being grieved by the Minnesota Association of Professional Employees (MAPE) – being represented by Rich Ransom.
The Authorities promised to provide documentation via security cameras on site. The documentation was not ultimately produced (it didn't exist), but I was forced to expend another $4,000.00 for what would now be “unconditional release” a legal obsurdity in my mind.
But the situation as described had occurred but not on 6 May, but on 30 April – prior to my initial interview & subsequent arrest and it is certainly documentable from on site security videos.
It did not accomplish anything for the Authorities initial charges ( the situation melted away in the night as they knew it had to) but it did succeed in robbing me of precious resources needed for my defense of that charge.
Certainly it must be illegal for a law enforcement office to file false police reports leading to an arrest.
How can I find out how to file a complaint against this officer? My present attorney has disregarded the incident and I cannot afford another one – but I cannot let this drop!
