Default ssi educaction and child support

I have an ex wife who has been recieving ssi for about 10 years. She has recieved a bachelors degree since begining to recieve it and is three years into a law degree. She was diagnosed with depression a ptsd and anxiety to begin recieving it. The whole time I have had a child support order that she has never paid because she is on ssi. The kids are almost 18 now. Is this legal for her to do this while the tax payers pay for her to get such a higher education on grants while her own kids go without. If so how long after the kids are 18 can I sue her for back child support after she is finished with school.

I can understand that this is frustrating for you. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You should certainly try to speak to a lawyer to determine what legal options may be available regarding petitions for contempt and how long you have after the children are 18 to file. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.

If you have a child support order do you use a local child support enforcement agency? If you do use them they should have already filed a contempt motion against her. However if a case has sat dormant for a long period of time they tend to get overlooked. The sqeeky wheel gets the grease and if you dont use a child support agency you should! They will do the enforcing of the court order for a very small fee. SSI can be garnished to pay child support also why are her minor children not receiving benefits due to her disability? My children do, on top of the child support being taken right out of my ex's monthly disability checks to ensure payments. Get on it ASAP to get any judgements in place for arrears she may owe. Good luck, she should be supporting her children!
