Default Disolving Special Needs Trust

Hello,

My son received a settlement after an accident when he was 17 and became paralyzed. We had a special needs trust set up for him at that time. He is now 26 and find the trust very difficult to deal with along with the fact that they and the financial institute that handles the funds seem more concerned with there fees than anything else.

My understanding is that since the trust was established in the court by a judge that we have to go back to court to get it dissolved. Is that correct, and what are our options?

Most likely you will need to go back to court. I would suggest that you speak with an attorney regarding this. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
