Unhappy Someone please help me

Me and my fiance sold our car to a man who paid with a certified bank check from Bank of America. We deposited it into our bank account and the bank put a hold on it for 4 days because it was for 3500.00. well we called the bank a couple days later to check our account and it said that it had cleared and is in our account.. so we took out 1800.00 for bills and stuff for our baby..but we had to take it out from the bank with a check because we dont have atm cards.. well a week later the bank called and said that the check never cleared because it was a fake check. well the clerks that cashed our check for 1800.00 should have known in the computer that the check hadnt cleared yet but still let us take it out. and now they are saying that its all our fault and want tho prosecute us unless we pay them the 1800.00 back. are we at fault or are they?please someone help

The first thing you need to do is file a Police report for the stolen car. This isnt going to likely help you with bank but it does support your arguement

I tend to agree with underdog, but you are going to be responsible for the money to the bank if they do not catch the guy. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own.
