Default Shareholder Rights

In this difficult time, we see a rise in shareholder / ownership disputes. There is substantial legal protection for access to financial records and expeditures by the partners or other owners.

Default Inspection of Records

Section 607.1604 provides for Court Ordered Inspections. It also provides that the "court shall dispose of an application under this section on an expedited basis."

I am confused as to what "an application" is, and what "expedited basis" means.

Has anyone ever proceeded under this section? Is the application formally served? Is there an answer?

I have already made written request for inspection with proper notice. The company basically ignored it.

Any comments appreciated.

Default Enforcing SH Rights

You need to enforce the matter with a legal proceeding, which entitles them to answer. I have been in numerous cases on both sides, and the advantage if you did it right is you are entitled to seek reimbursement of your legal fees.
