Default shared legal custody

ok, i'm gonna try to keep this short.. i had my daughter, gabby since birth, but filed for custody after a visit w/ her dad wen he threatened to keep her. the court granted shared legal custody, it was a b.s. hearing, they didn't listen to anything i said, and i had a free lawyer, anyway, i had a judge hearing as an appeal set for january, but had to move due to my grandma's health, to the county her dad lives. after i moved, i called my lawyer and asked if i was legally allowed to live in a county and attended this other conference in a different county. i stressed to him the importance of changing the existing order, since i didn't agree w/ it.. anyway, he was stupid and told me yes, he would put in a change of venue or w/e.. that was in august 2005. here i am, in feb of 2007 w/ a lawyer, but still no action. i was told up until now that my case had never been transferred to this county, but i called the prothonatary the other day and they said they have it. i called and informed my lawyer, and he said he'd look into it and get back to me, this is of course, another pro-bono lawyer. i have several concerns, such as for about a 6 month period, the 2 weeks her dad had her, he would take her and drop her off at his aunt's for that period. since then, his aunt has gotten a job, but i know for a fact that she was w/ his aunt from saturday until tuesday. is there anyway i can move this thing to court faster? gabby eats herself sick, and the doc's say it's probly cuz of stress, since she goes from my house, to dave, to his aunt, to him and back to me. does anyone know of any software that can help me format the court documents to do myself? and if so, are there documents for me to file to waive the filing fee?

you could file an emergency petition but the filing fee is more. If you think you can't afford the filing fee, you could fill out whats called an In forma Papa Raupis, need to check the spelling on that one. Basically is a form you fill out an d and with the court telling them why you can't afford to pay the filing fee and the judge willl decide on whether to waive the filing fee or not.

I understand that this is a stressful situation for you. Have you thought about speaking with another attorney? Some will work with you on a payment arrangement.

yea, they all want retainers up front first, and the cheapest was $500.. i actually just got a call back from my lawyer's secretary today. i guess calling everyday and leaving messages for a month got him off my back. I have a meeting with him on Monday, so I hope everything goes okay, but if not, income tax return is right around the corner and I will get a pay lawyer, at least they would be motivated to call me back.
