Shady Dealer Repossessed my vehicle when no money was due.
I bought a car from Pride Motors (Entity ID Number 495 - 531) on a vehicle loan that they held for me. 3 days after my purchase the car broke down. As result of poor maintenance the engine need to be rebuilt. I talked to Pride Motors who told me they were not obligated to give me any refund, or help with the vehicle because the vehicle was purchased "AS IS". I'm not originally from the Mobile Area and thought this may have fallen under a lemon law. I told the owner (Ed, seems none of his employees know his last name) I was not going to pay on the loan until the car was fixed. I bought the car so I could get to work with reliable transportation and I couldn't afford to fix the car AND make the payment. He eventually said he would give me time and we set a date when I would start making payments again (Nov, 6th), his Secretary, Jessica was present at the time of the deal (Witness).
While this was going on I was also asked to fix a vehicle for them that they had bought from the auction (2001 Mercury Cougar) to get it ready to sell, in return he would take my labor off the price of the vehicle I bought from him (2003 PT Cruiser). His car was fixed and as I was returning it the transmission slipped out of gear. I did nothing to the transmission but he told me I took out the old trans and sold it, replaced it with a broken one. I said that was absurd, I was trying to make money, contacts, and a good reputation for my business. I wasn't going to ruin my reputation for a 500 dollar transmission. In fact, I did so much extra to the Cougar to make the appearance more attractive to "would be buyers" I didn't even charge him for. I figured he was doing me a favor by giving me business; I was willing to go the extra mile to get more from him. Besides, the transmission was fixable with a 40 dollar part and I volunteered to fix it for free, and if I was wrong I would pay for the part out of my own pocket. He opted to not have it fixed and towed it to his location. He was going to take it to auction to sell it. He did give me cash for the parts I paid for out of pocket and told me he would apply my labor (10 hours at 45 an hour) to my auto loan.
Meanwhile, trying to gather parts for my PT cruiser. I had the head work done by a local machine shop. Bought a new turbo, gaskets and other misc. parts for the engine such as bearings, pistons, valvetrain. He had a repo man come to my house to take the vehicle, I was frustrated with the project so I was willing to surrender my PT Cruiser. I offered the car to the repo guy and he decided not to take it because of the condition of the car(Witness). Fast forward to October, I got the PT cruiser fixed and driving great. I called him to make my payment and get the title. We met and I made the cash payment of 100 dollars. He told me it would take a couple days and he would get back to me.
I have been trying to get a transfer to Northrop Grumman's (my employer) buffalo site. I had a friend who said he could speed up the process. I took some vacation and told Pride Motors that NY state would not accept the "Application for Title" and needed the original. I pointed out to Pride Motors that they could still be the lien holder by signing the back of the title. He had his secretary call me to set up a meet, when I arrived a repo man was there locked me in the dealership and told me he was taking the car. I called the police and waited almost 3 hours for them to arrive. I was verbally harassed by the owner and one of his salesmen. I found out he never applied my labor charges to my loan and made it look like I didn't pay him. I didn’t want this to turn into a big ordeal. I felt like I was being fair to notify him I was moving and to offer a way to maintain a lien on the car. He was absolutely disrespectful to me and my character after being so nice and understanding a few days before and working with me on the payment of the car. I am at a loss for my time and money spent on the car.
Now because I have a business and did work for Pride Motors do I have any rights to place a lien on the titles of either cars? Do I have any rights at all?
Would someone please point me in the right direction. I have filed complaints with the FTC, and the Attorney General. I have pictures and video of work performed as well as a video of the night the Repo took place with him being belligerent, cussing, and locking me in his facility that I am prepared to release to the local news channels.
Thank you for your help. I have been trying to do research on my own but how the law is written is difficult for me to understand such as Section 32-13-4Notice of sale; hearing; appeal or Section 40-12-391
I have searched to find if he has a valid dealers license and not just an Entity ID. I don't know where to search.
