Angry Security Deposit

Setting the Stage- I had been renting a townhouse in Florida since may 2010. Because of my job I would pay the lease 3 months in advance because of my extensive overseas travel. I had a live in girlfriend that would stay at the residence while I traveled. In November of 2010 I had to travel overseas for an extended period of time and paid the rent through Jan 31, 2011. Well as things happen, my girlfriend and I broke up and she continued to lease the townhouse for 6 more months.

At the time I paid the the first 3 months of the lease I paid the amount that was required. Shortly after a few months, I received an email stating I needed to pay the security deposit. I paid the security deposit with a cashiers check from the bank and signed a Tax form 1099 (I suspect was for accumulated interest on the deposit).

As I am still overseas I received an email requesting the remote controls for the garage and the gate or the cost would be deducted from the security deposit. I replied and explained that I was not able to retrieve the remotes in the time frame they had requested to just deduct the amount. I went on to advise them to just deposit the remainder of the funds in to my Deposit only account along with the account number. I then get an email stating they had mailed the security deposit to my ex-girlfriend because she was the one living in the residence.

I have sent 2 emails and have not gotten response to resolve this.

What can I do legally at this point?

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
