Default Secondary Leaseholder

I am the primary holder in our apartment.
We've gotten more than one eviction notice because my roomate
doesnt pay on time. ever sine we've moved hes never given me the
money on time therefore we constantly get late fees and eviction notices
i told him to move out and he said he legally has 90 days for him to move out without paying anything.

As far as the landlord is concerned, it doesn't matter who is paying late. If the full amount of agreed rent is not paid by the agreed due date in your lease, the landlord has the right to begin the eviction process. If you want to see the step by step process an eviction will take, you can take a look on our website, we have a "How It Works" section that explains it. You will first receive a 3 Day Notice, which is basically just telling you that the eviction is coming.
