Question School Injury and Liability

My daughter plays basketball for the school team and during a practice
she was tripped from behind by another player. She consequently torn ligaments in her wrist and surgery and a lot of reabilitation followed.

The procedure that was stated is that we use our primary medical coverage initially and the balance is then sent to the school's insurance for payment.

This was done however after our insurance reached the yearly limits the school's insurance reached their event limits on the two MRI's that were
taken. We have paid our co-pays during the office visits and the school insurance is suppose to reimburse these as well.

The problem is with the MRI in which there is a $2000.00 balance due.

Is it still the responsibility of the school to pay for these charges ?
Does having a secondardy insurance policy mitigate the remaining school's liability in this matter ? Especially when the the secondary policy places a low event limit of this specific item ?

Do we have action against the other player that tripped her for recovery ?


Since this issue the season has again began and during team conditioning they were running on the cross country trail and my daughter stepped on a root coming our of the ground and injuried her foot. We elected to not have an MRI performed because we could not afford ultimately another $2000.00
bill.

This simply does not seem right ???

I can understand this is a frustrating situation for you. Many school are now requiring consent/waiver forms to be signed in order to participate in sports programs at the school. You could try to ask for a copy of the school's policy on providing insurance coverage to find out more information. You can certainly also try to speak to an attorney regarding your legal options with the outstanding medical bills.
