Default Road Association Woes

Our family camp is off from a private dirt road that joins into another private road, where we have to travel on it approximately 75 feet to get to a city road. Our family has been traveling this route since the late 1950's. Within the past 10 years, the larger private road has been paved and extended to almost 3 times it original length and as a result, the home owners on that road have formed an association. The problem is that they continue to "charge" our family dues to their association even though we do not live on that road. They attempted to place liens on the past due offender's camps but the judicial system kindly informed them that since we do not live on their road, we are not responsible for paying their dues. They also mentioned that the right of way was grandfathered since it existed prior to their formation. Still they press on, hoping to find a loophole or mechanism to force us all to pay past due balances since their creation. They also publish a yearly document that clearly defines us a past due for all of their association members to see. Is there any way to get them to stop publishing these ludicrous claims and making us out to be "malcontents"? I think its a bit unfair to have our name tainted even though the courts have agreed with us and our predicament.

You can try to take them to court to enjoin them from publishing your name. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
