Default road association problem

we have rebuilt our driveway on a private road in acton maine and the road association believes we have built on the road. We have pictures showing we have not. nor did they say anything when we had a tree removed which if they are correct would have been on the road (at a cost of 4000.00) what are our rights and how should we proceed? we appreciate any insight into this issue,

You have not given enough information for anyone to reply. Have they threatened legal action or what do they want you to do. Basically what is the problem and your legal question.

Most of what they've done so far is threaten us. They first said we had an erosion problem and "someone" would call the EPA. We had the contractor fix what they thought was the problem. Now they are saying we built into the road. We do not believe we have and even the town code enforcement officer did not seem to have a problem with the wall when he did some of his inspections. They have not made specific threat to prceed legally however they referenced a local surveyor who stated we transgressed into the road. This surveyor has not surveyed my property to my knowledge. They are finding one issue after another and I merely want to protect us and stop this behavior. This may just be a bluff but I want to know how I should proceed should this go any further. Thank you

Honestly, I would wait until they actually take legal action. At that point, get an attorney immediately so that you don't miss any filing deadlines. You can locate an attorney through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/. Some do offer free consultations.

The association is now saying since we were doing construction we should have widened the road at our expense what is the legality of their claims?
