Right to refuse service with contract?
I owned a photography studio for 4 years and closed a year ago. I fulfilled all contracts that were written before closing. I have one client that has been extremely rude and ugly and has run my name in the mud because she does no have wedding photos yet but only because of her failure to pick them out. I ended up designing an album for her because she would not pick pictures out but she will not approve for me to order but insists on change after change after change, to the point that I am not going to change anymore. The client signed a contract but has breeched twice. First, by not paying package in full 14 days prior to the wedding. She paid retainer fee when the contract was signed and paid $1000 on the day of the wedding towards the package because I would not take pictures without more money paid. (This is not the full package price. Client still owes around $1000). The client states that she no longer has proof c.d.s to return to me. The c.d.s are only included in the $5000 package so in that case with what she has and what she has paid, I would call it even. I emailed the client because she has moved and no other way to contact her to inform her that I would not tolerate being treated so ugly and to send me a current address that I was returning what she has paid and would no longer do business with her. Also that I would include a signed copyright release for her to have someone else do album or print pictures. Client also took pictures from proof c.d. and has posted them on facebook without permission although contract contains copyright agreement. She has now sent email back saying to not contact her anymore but be ready to "get sued" and was having her lawyer contact me.
My questions, What is my right to refuse service?
Am I required to refund money?
Am I required to complete my end of contract since she has breeched her end?
