Default residental custody of my daughter

My daughter is 16 and lives with her dad. But now she wants to move back with me. We have joint custody and he agreed to her moving backback until I wouldn't call child support enforcement to tell them he didn't own me back child support. Then a few days later he sent a text to my daughter saying he would support her decision on moving back with me. Until he was served custody papers. Now he is making her go back. What are my rights?

That's not how it works. Wishful thinking on his part.

You have the right to make the arguement to the judge or custody moderator that the child will be better off with you and to have the custody order amended if the judge or moderator supports that outcome. You've already started that process apparantly by having him served, now you just need to see it through.
