Default repossing a car

we sold our car and on the contract it states that default occurs after thirty days from the last payment. Well it will be 31 days tomorrow. do we need any legal paperwork from a court or anyting to reposses or can we just go get the car as we planned to tomorrow? We are leaving him a note (he was renting a room in our house and we are in the process of evicting him) The note states " As per our contract we are repossessing the car default occurs after 30 days and your last payment was Dec. 20. Please remove your personal items from the vehicle immediately and return all deys and deyless remote entry devices. Dated pictures of the car inside and out wer taken on Jan. 19th. The car will be left in the condition it was on Jan 19. except for the removal of your personal effects. Myself or my Husband must be present while you are removing you personal effects. Authorties will be called immediately if there is any new damage. orginal question: Do I need a court or other legal document to reposess? Thank you
