Exclamation Removing The Subletter From Hell

I rent a private home in cook county, a near northwest suburb. I am the sole name on the lease, and had 2 roommates previously who moved without issue. Then I took on the roommate from hell.

He's 20 years old; on a private credit check (I used to work as a credit analyst) he seemed golden; now I highly suspect he used the information of another individual with the same name in the same state (FL) from which he moved.

Originally I posted an ad for 2 rooms to be let at $600 plus utilities. I said with an full load of 4 roommates, utilities in sum total would run about $120 per person. He moved in and we agreed to go month-by-month with no contract in writing.

I had potential roommates coming in and one wanted an additional room. I spoke with the 20 year old gentleman who agreed to go down to one room for $300.

After one month, it has come time for him to pay bills. He refuses; citing he believes we never discussed bills (I have emails to prove we did) and as the next 2 roommates have not come, I did ask him to pay half the bills, about $240, but he refuses to pay any.

He paid November's rent of $300. Due to his refusal and other issues (his dog has ruined the floor of 1 room, and he was using spare furniture of mine, of which he broke the bed), I asked him to leave by 11/16, halfway through the month.

He insists that a payment of $300 means he can stay the full month. I am asking him to leave, and in lieu of the $240 in bills and over $500 in repair costs he generated (he did not give me a security deposit) I would keep the $300.

I offered that $150 would be half a month's rent; the last $150 would cover bills and repairs if he would just leave.

He refuses to, and I do not feel safe leaving my dog alone with him while I work. He is promiscuous and brings home strange gentleman constantly who stay 1-2 days at a time. He has also used $100 in paper goods and cleaning supplies he has not replaced.

I do have good reason to kick him out, but can I legally do it on the date I set of the 16th, halfway through the month when he has paid a full month's rent, but refuses to pay repair costs and bills?

Default Is that an automatic reply?

Not sure if that's an automatic reply. I did search through those archives, but found nothing guiding my particular situation as I have no written contract with this young man.

I do have a friend who is a lawyer, but he is out of town on a family emergency, unreachable, and expects to be back by thanksgiving.

I was hoping someone could point me in the right direction ASAP so I can get him out of here.

I am sorry you couldn't find anything useful. You may want to check your local court for rules on eviction proceedings.
