Remove website printout evidence from case
Is there any possible way to have printouts of my website pages obtained by a state regulatory agency inspector over a year ago removed from evidence from a pre-trial/trial?
Its a long stretch - but if I were able to get that evidence removed as being unlawfully obtained or otherwise - I would easily win this case.
What are possible legal defenses to state agency printing out pages of my website for use in regulatory actions when website is not owned by me?
#1 website was active for about a year and a half - was designed to be a professional referral service website that charged consumer a fee and referred them to a professional who would perform a specific task. In this case - real estate related.
#2 website never generated any business.
#3 state real estate commission (Kansas) going after owner of website as illegal brokerage - however the site is operated by separate LLC I happen to own that does web marketing. I am also owner of a licensed Kansas brokerage - thus the idea - different LLC, however was clearly indicated (I think) on several pages that the website is simply a referral service and classified site only.
#4 real estate commission inspectors evidently visited the website, printed out several pages and omitted many of the pages which indicate the intent of the site and are using them as evidence in interrogatories and such to court.
#5 I shut the site down after they filed petitions in court and I determined it was not worth the fight to keep a site open that did no business.
Q: Is there any way to get the print outs of the various pages removed from evidence? - Any legal defense to print outs of web pages in general?
Q: Referral to anyone at DOJ or FTC for restraint of trade laws in place by Kansas?
