My company allows for (1) non-recoverbale draw and 5 recoverble draws against commisions. Due to a co-workers negotiations for (2) non-recoverble draws, I was compensated what was believed to be an additional non-recoverble draw as well. There were no conditions or communication as to what this payment was for as it was paid without notice(it just showed up one day in my bank acct). I am leaving the company and now they want the second payment back. Do they have the right to do this?
I will copy your post to Labor and Employment forum for more exposure. You really would need to contact an attorney regarding this, however. These things tend to be highly fact specific and the employer's policies, etc. would need to be reviewed.
