Default Rear-ended by school bus, need legal help/advice

I live in Florida, and in Novemeber of 2008 a was rear-ended by a Pasco County School Bus. They admitted they were at fault, and told me they were going to pay for the damages done to my car. They sent someone to come assess the damage after I ran around town and got three different estimates for them. I didn't hear from them for about a month. I then get a call from my insurance company saying they aren't going to be paying for the damages because the day before that myself and another driver were backing out at the same time, going about 2 MPH and it left a little mark on my car. Now, you can definitely tell I got hit by a school bus because of certain marks left on the car. It is in total about $3,000 dollars worth of damage and I was just wondering what I should do to get them to pay for the damage that their bus driver caused. Also, no police report was filed.

I understand that this is frustrating. If they are refusing to pay, you are going to need to file a suit against them. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own.
