My family and I live in a lower level duplex. We have lived here about 6 mths now we have had a problem with our washer waste drain overflowing ever since we have moved in. Our former landlords husband took over the property and has known about this since then (which was about 5 1/2 mths ago). The city inspector came about 1 mth. ago and stated that it needed to be fixed. He also stated that the furnace needed to be inspected and needed to install a CO2 detector none of this hass been done yet because we are withholding the rent until it is done. We have also verbally notified him that we are moving out because these things have not been done. My question is do we have the right to withhold rent until these things are completed and also do we have to stick to the rules of the lease and give him 30 days notice to move out?
