I have a two year old son whom I have taken care of and loved the whole time. His father has never paid any type of support or come by or called to see him. I never filed for child support or seeked any advice. He also has a five year old from a previous girlfriend who he does not support either. He now has a new baby with a new girlfriend who he finally has decided to care for that one. My questions are: 1)can i have his rights taken away? 2)and can he change his mind one day and decide he wants visitation? This eats at me every day I could use some advice

Hi ~ Out of personal experience I can give you what I know. 1 - You really need to establish custody and child support orders for your child. Whether you like it or not since there is no custody if the BF decides he wants to see your son and then takes off with him you have no grounds to stand on since he is his biological child and there is no custody arrangements. 2 - The state of Texas DOES NOT like terminating the rights of a biological child. Unless you have legal reasons to terminate and someone there to adopt you don't have much hope for termination. I know this isn't the info you wanted but for your son's sake get to court and get custody of him. After you establish all the court orders then he still doesn't comply then you will have grounds to terminate. Best of luck!
