Default Question about using NFL Statistics and Trademarks on a commercial website

Hi,

I have questions about the use of NFL statistics, player and team names on a fantasy football website being used for commercial purposes. I am considering starting a fantasy football website that hosts fantasy football leagues.

1) Do I have to obtain a license from the NFL Player's Association in order to use automated/streaming statistics from NFL games for commercial purposes?

2) Am I allowed to use player and team names without a license for commercial purposes? So can I use the player 'Eli Manning' on my website as a player in my database; and can I use the team name 'New York Giants' or even the city 'New York N' ('N' as in NFC)?

I am asking because I do not fit the minimum requirements for obtaining an NFL licensing agreement.

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You should certainly try to speak to a lawyer to determine what legal options may be available. You don't want to have to deal with a lawsuit down the line. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.

This is a very good question, I see tons of these fantasy football sites and know they don't have any licensing agreements with the NFL. However, they stick around for years and so do sports betting sites. I'd have to "assume" you would be violating some sort of agreement by using team names (not player names) but if they would actually puruse the matter is entirely different.
