Any advice would be appreciated. We have a contracting business that has been operating under the same name for over 56 years. We are incorporated. It is a generic name lets say xyz window Company. 10 years ago I launched a website called xyzExteriors.com and started doing alot of marketing for our website with this name, and on our letterhead, advertisements etc. I did not trade name xyz exteriors until 2007. Recently, we have been getting confused by mostly distrubutors and some customers because there is a company called xyz Exteriors inc. that is participating in my exact same business and same geographic area. They incorporated in 2003. However, not until 2008 did they really start to do more business, when I think they decided to try and compete, they launched a website called GotxyzExteriors.com

Can we prevent this company from doing business as xyzExteriors? For the last ten years, in our area, all of our distributors and alot of our customers know us as this name and our regular name xyz windows.

Any help would be appreciated.

A lot of this is going to come down to how your company was incorporated and if you have a tradename, etc. I would certainly suggest speaking with an attorney because if you attempt to stop them from doing business, it will end up in court one way or the other.
