Default question about consent in a nursing home

on 3/12/9 my mom signed a form at the nursing home, that read CONSENT TO SIGN my mom is requesting that I sign all documents on her behalf.

on 3/24/9 in the nurses notes they checked the following statements Mood unimproved AND indication of problem with cognitive ability/memory, decision-making ability, and ability to understand. They also checked under COMMUNICATION SKILLS Resident has communication problems.

I had received a phone call from the facility because they wanted to put her on Trazodone, which is a drug I had bad effects from, so I told them I was not overly fond of that drug, they answered back well it would only be a small doseage.

on 3/24/9 They had my mom sign a form that read INFORMED CONSENT TO USE PSYCHOTROPIC MEDICATIONS and they checked Consent to the use of this medication and had her sign it.

my question is do I have any recourse do to the way they handled the drug, after doing research on the drug I found out it should have not been givent to a patient with heart disease and high blood pressure which she had both.

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
