Default problems with townhouse association

My husband and I have lived in our townhouse for a little more than 2 years. We bought it as an estate sale. The first week we moved in (January) we were hit with a snow storm and noticed the carpet in our guest bedroom was wet. It was here we realized we had a 6 x 4 icedam on the back our house that was causing our roof to leak.
We immediately contacted our association and the realtor. We pulled back the carpet only to see that the carpet pad had previously been cut out and replaced, (thus the problem had occurred before), this was never revealed to us in the sale. From here we bleached the floor, removed the carpet pad and replaced it.
The president of the assoc. who was also the builder, basically said they only thing that could be done was to put heat tape on the roof in the Spring. This finally happened in October 2006 (1 1/2 later) and after this hard winter in the midwest, did not alleviate the problem.
Long story short, we are still having the same issues. The townhouse association has had a roofer and insulation person come and advise that the pitch of the roof is probably the main cause of this problem (as we are the only townhouse in the assoc. with this pitch and the only one experiencing problems), as snow and ice funnels there. The roofers went up and advised they did some "patching" and would return the following day to discuss, they never did. My husband and I are planning on buying a house, but cannot do so until the problem has been fixed. We do not want a bandaid, we want the problem handled appropriately. We have kept a journal of everything and have waited VERY patiently for 2 years for a resolution, with none in site. We are considering hiring a lawyer. We are going to send a certified letter as king for a timeline and action plan by May 1. Any other suggestions on what we should do? Help!

I can understand that this is a frustrating situation for you. I would suggest that you post this under real estate to get some better responses. I do think that it would be the best to speak with an attorney to discuss your legal options.
