Default Power of Attorney Abuse, Is there anything I can do?

Hello all, First off i would like to apologize if my post is not in the proper category, However i come to seek advice from those of you who are much better versed in law than I.

Long story short, My father was incarcerated a few years back and made his sister (my aunt) His power of attorney, to look over his retirement fund, to help his kids (me included) and to send him money when he needed it. Fast forward to a few months ago, when he was switched to a permanent facility he contacted his bank to get a bank statement for the last few years. Found out that his sister had spent almost $20,000 of his retirement fund on things for herself, paid off her car, every other week there was $500 walmart shopping sprees, car insurance and many other things.

As soon as he found out, he took her away from POA and appointed me the new POA, Now what I want to know is, is there any ground for me to take her to court to get my fathers retirement fund back? How successful do you think a suit would be?

Thank you all!

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
