Question Personal Property Theft Small Claims Case

In May 07, my car was towed by AAA to a car dealership to be repaired. They had my car over a week and could not fix it. When I went to retrieve the car, they gave me the keys. When I unlocked the car, the car and trunk had been ransacked and my 2 CD wallets had been stolen. This was over 200 CDs and I am suing the car dealership in small claims court for $2000. They tried to get me to file the case with my homeowner's insurance or imply that the AAA tow truck driver stole the CDs. I was told by an employee that the dealership had problems with vandalism of cars on the new car lot but had never seen a problem with cars in the service department. Do I have a case? If so, what is my legal premise. Can I use the fact that there appears to be a history of theft and vandalism and that they did not warn me to come retrieve my car or remove the CDs? I have not seen a sign that says they are not responsible for lost and stolen goods but I have only been to the dealership once.

Well, was your car damaged, broken in to? If not, then it was someone that had the keys, either the dealer or the tow driver. Have you tried to work it out with both companies?

No my car was not broken into. The doors and windows were intact. I have attempted to work it out with the car dealership but not AAA, I guess I could contact them this week just to make sure I cover all of the bases before my July 2nd small claims case.
