Personal Liability in LLC- 5 day countdown
I was personally sued in small claims court by a supplier of products purchased by the LLC of which I am the managing member. They won, even though the styling of the case was against me personally plus naming the DBA of the business location; the LLC was never named. I objected to this at the time of the hearing, but the judge didn't disallow their case.
They got the judgment, but according to the courts own form they had (3) three days to notify me of the judgment and did not. I have a letter dated 30+ days post judgment from them that I have not opened.
Now, they have filed a garnishment on the LLC bank account and the bank is withholding an undetermined amount of money! (No amount stated in the garnishment paper mailed to me 30 mins ago). Is this right? If they didn't name the LLC in their original action, how can they now come after funds held by the LLC?
A speedy reply would be helpful as I have only (5) days to respond and need to know what to object to on exemption grounds. TIA
