Personal Bankruptcy and My LLC
i am the sole member of a LLC. i have a personally guaranteed SBA Loan for my company (which i cannot pay back). I have just filed for Chapter 7 Personal Bankruptcy and i am about to be successfully discharged (the SBA Loan was part of this discharge). my company is a design firm, and i have essentially zero assets- no cash, car, office, house, equipment, etc (except for a laptop and a printer, and some basic office supplies).
while my company has not been successful, i am on the verge of landing a few decent contracts. my questions are: 1. can i keep the business open? 2. will my creditors try to sue my company, or somehow try to get at my income once i start earning a profit? 3. should i just close the business? i have been getting calls after my Chapter 7 meeting that a collector representing the US Treasury is asking about the SBA Loan.
What do i do now?
