Permanent Guardianship - Illegal Immigrant Rights to Open a Case?
We were recently awarded Permanent Guardianship of two half-siblings after being with us as foster children for 2.5 years. There was no father on the case, and the mother eventually stipulated Permanent Guardianship as a goal (she did not want to "give up" and sign surrenders). Since then, the likely biological father (he looks exactly like his son) wants to come forward and reopen the case. He was not on the original case. He currently is (and has been for at least 3 years) an illegal immigrant from a country where he can not claim asylum. Does he have the right to re-open the case? Once he does it, will a red flag go up as he is currently here illegally?
